ورد سؤال من القارئ / محمود عزام – بالإسماعيلية يسأل فيه عن حق الابن المولود لأم مصرية وأب غير مصري ويحمل جنسية دولة عربية فهل يحق له أكتساب الجنسية المصرية وكيفية ذلك

عالج المشرع هذه المشكلة الاجتماعية التي باتت تؤرق الكثير من الأسر بسبب زواج المصرية من زوج أجنبي وإنجاب أطفال يحملون جنسية الأب بالتبعية ، إذ بصدور القانون رقم 154 لسنة 2004 بتعديل بعض أحكام القانون رقم 26 لسنة 1975 ( قانون الجنسية المصري ) والذي قضى في المادة الأولى منه بتعديل المادة 2 ليعتبر مصريا من ولد لأب مصري أو لأم مصرية وقد خول القانون في المادة الثالثة منه ، لمن ولد لأم مصرية وأب غير مصري قبل تاريخ العمل بهذا القانون أن يعلن وزير الداخلية برغبته في التمتع بالجنسية المصرية ، وقضى بأن يعتبر هذا الشخص مصريا بصدور قرار بذلك من وزير الداخلية أو بانقضاء مدة سنة من تاريخ الإعلان دون صدور قرار مسبب بالرفض وقد استهدف المشرع بهذا التعديل المساواة بين الأبوين فيما يتعلق باكتساب الجنسية المصرية الأصلية وذلك بالولادة لأب مصري أو أم مصرية بعد أن كانت الجنسية تكتسب فقط لمن ولد لأب مصري وذلك معالجة لبعض الآثار القانونية والاجتماعية التي كانت تثار قبل التعديل ، وقد عالج المشرع بالمادة الثالثة حالة الشخص الذي ولد قبل العمل بالقانون رقم 154 لسنة 2004 لأم مصرية وأب غير مصري بحق هذا الشخص في إعلان وزير الداخلية برغبته في التمتع بالجنسية المصرية التي يكتسبها الشخص بقرار من وزير الداخلية أو مرور سنة دون صدور قرار مسبب بالرفض ، أي أنه على الطالب تقديم طلب لمصلحة الهجرة والجنسية بالقاهرة يفيد رغبته الصريحة في اكتساب الجنسية المصرية واستيفاء الأوراق المطلوبة وسيصدر قرار وزير الداخلية بمنحه الجنسية المصرية وإذا تم الرفض مسببا فيمكن التظلم والطعن فيه بما يفيد الرد على أسباب الرفض أمام القضاء الأدارى ، وإذا لم يصدر هذا القرار رغم مرور سنة فيعتبر هذا قرارا سلبيا بأكتساب الجنسية ويصبح مصريا بالفعل بمرور هذه المدة دون رفض مسبب
