قانون تعديل الرسوم القضائيه الجديد2

[الافوكاتو]

مادة (74) ( الفقرة الأولى ):
" يفرض عند الانتقال خارج المحكمة رسم مقداره خمسة جنيهات فى حالة الإشهاد
وجنية ونصف فى حالة التصديق وذلك بخلاف مصاريف الانتقال "0
( المادة الثانية )

يستبدل بنصوص المواد (18،12،8،2،1"الفقرة ثالثاّ") من القانون رقم 93 لسنة 1944 بشأن الرسوم فى المواد الجنائية ، النصوص الآتية :
مادة (1) :
"يفرض رسم ثابت على القضايا الجنائية التى تقدم للمحاكم أو التى تصدر فيها النيابة العامة أوامر جنائية بالفئات الآتية :
1.5 على قضية المخالفة
1.00 على قضية المخالفة المستأنفة 0
5.00 على قضية الجنحة 0
10.00 على قضية الجنحة المستأنفة 0
30.00 على قضية الجناية 0
وتعتبر القضية مخالفة أو جنحة أو جناية حسب وصف النيابة العامة للجريمة ما لم يخالفة حكم المحكمة فيسوى الرسم على هذا الأساس ويعتبر فى حكم الجنحة الجنايات التى قرر القانون لها عقوبة الجنحة 0
20.00 على قضية النقض 0
فإذا أحيلت الى محكمة الموضوع للفصل فيها مجدداّ أو فصلت محكمة النقض فى الموضوع لا يفرض رسم جديد 0
20.00 على قضية رد الاعتبار "0
مادة (2) :
" يفرض رسم ثابت مقداره جنية ونصف يلزم به المحكوم عليه فى مسائل التشويش بالجلسات وفى حالة غياب الشهود وامتناعهم عن الإجابة وفى المعارضات فى الأحكام الصادرة فى هذه المسائل "0
مادة (8 ):
" يفرض رسم تنفيذ مقداره خمسون قرشاّ فى قضايا المخالفات وجنية ونصف فيما عدا ذلك 0 وهذا كله إذا كان التنفيذ بواسطة قلم المحضرين 0
ويتعدد الرسم بتعدد الأشخاص الذين يتناولهم التنفيذ 0
وتخفض هذه الرسوم الى النصف فى تنفيذ الأحكام الصادرة على الشهود ويفرض علاوة على ما تقدم رسم انتقال ثابت مقداره خمسون قرشاّ فى قضايا المخالفات وجنية ونصف فيما عدا ذلك "0
مادة (12) :
" يفرض على الصور التى تطلب من السجلات والاشهادات والأوراق القضائية وغيرها رسم مقداره خمسون قرشاّ عن كل ورقة وبحد أقصى مائة جنية عن الدعوى الواحدة"
مادة (18) ( الفقرة ثالثاّ) :
" الإعلانات الأخرى التى يطلبها المدعى بالحقوق المدنية أو المسئول مدنياّ يؤخذ عنها رسم مقدارة خمسة وعشرون قرشاّ عن كل ورقة من الأصل والصورة فى قضية المخالفة وخمسون قرشاّ فى قضية المخالفة المستأنفة أو الجنحة الابتدائية أو المستأنفة وخمسة وسبعون قرشاّ فى قضية الجنائية وجنية فى قضية النقض ورد الاعتبار "
( المادة الثالثة )

يستبدل بنصوص المواد1 (الفقرة الثانية )، 3 ( الفقرة الأولى ) ،14،5 من مرسوم تعريفة الرسوم أمام مجلس الدولة ، النصوص الآتيه :
مادة (1) (الفقرة الثانية ):
" ويفرض فى دعاوى الإلغاء رسم ثابت مقداره عشرة جنيهات وفى الدعاوى مجهولة القيمة رسم ثابت مقداره عشرون جنيهاّ "0
مادة (3)( الفقرة الأولى ):
" فى دعاوى التماس إعادة النظر يفرض رسم ثابت مقداره عشرون جنيهاّ "0
مادة (5) :
" لا تحصل الرسوم النسبية على أكثر من ألف جنية فى الدعاوى التى لا تزيد قيمتها على أربعين ألف جنية 0
ولا تحصل الرسوم النسبية على أكثر من ألفى جنية فى الدعاوى التى تزيد قيمتها على أربعين ألف جنية ولا تجاوز مائة ألف جنية 0
ولا تحصل الرسوم النسبية على أكثر من خمسة ألاف جنية فى الدعاوى التى تزيد قيمتها على مائة ألف جنية ولا تجاوز مليون جنية 0
ولا تحصل الرسوم النسبية على أكثر من عشرة آلاف جنية فى الدعاوى التى تزيد قيمتها على مليون جنية 0
وفى جميع الأحوال ، يسوى الرسم على أساس ما حكم به "0

مادة (14) :
" يفرض على الصور التى تطلب من السجلات والشهادات والملخصات والأوراق القضائية وغيرها رسم مقداره خمسون قرشاّ عن كل ورقة وبحد أقصى مائة جنية فى الدعوى الواحدة "0
(المادة الرابعة )

يستبدل بنصى المادتين (3،2) من قرار رئيس الجمهورية رقم 549 لسنة 1959 بشأن الرسوم أمام مجلس الدولة ، النصان الآتيان :
مادة (2) :
" يفرض رسم ثابت مقداره خمسة وسبعون جنيهاّ على الطعون التى تقام من ذوى الشأن أمام المحكمة الإدارية العليا ، كما يفرض رسم ثابت مقداره أربعون جنيهاّ على طلبات وقف تنفيذ الأحكام أمامها :0
مادة (3):
" تطبق الأحكام المتعلقة بالرسوم القضائية فى المواد المدنية فيما لم يرد بشأنه نص خاص فى الأحكام المتعلقة بالرسوم أمام محاكم مجلس الدولة "0
( المادة الخامسة )

تلغى المادة 13 من القانون رقم 93 لسنة 1944 بشأن الرسوم فى المواد الجنائية 0
( المادة السادسة )

ينشر هذا القانون فى الجريدة الرسمية ويعمل به من اليوم التالى لنشرة
يبصم هذا القانون بخاتم الدولة ، وينفذ كقانون من قوانينها 0
صدر برئاسة الجمهورية فى 6 جماد الآخرة سنة 1430 ه
