قوانين 2009 : 1- قانون الرسوم القضائية

الأعزاء الزملاء : سنقدم لحضراتكم تباعا مجموعة من القوانين الصادرة خلال عام 2009 طبقا للمنشور بالجريدة الرسمية وذلك هدية لأعضاء منتدى السنهوري



قانون رقم 126 لسنة 2009


بتعديل بعض أحكام قوانين الرسوم القضائية


فى المواد المدنية والجنائية وأمام مجلس الدولة

باسم الشعب
رئيس الجمهورية
قرر مجلس الشعب القانون الآتي نصه وقد أصدرناه :
( المادة الأولى )

يستبدل بنصوص المواد 1 ( الفقرة الثانية ) ، 3 ( الفقرة الثانية ) 4 ( الفقرة الآولى )، 9، 30 ( الفقرتان الأولى والثانية ) ، 31، 32، 34، 35 ( الفقرة الأولى ) ،36 ، 38 ( الفقرتان ثانيا وثالثا ،42 ( الفقرة الأولى ) ، 46 ( مكررا ) ( أولا ) ،54 ،55 ، 57 ،60، 68، 72، ( الفقرة الاولى ) ، 73، 74 ( الفقرة الأولى ) من القانون رقم 90 لسنة 1944 بالرسوم القضائية ورسوم التوثيق فى المواد المدنية ، النصوص الآتية :
مادة (1) (الفقرة الثانية ) :
" ويفرض فى الدعاوى مجهولة القيمة رسم ثابت كالآتى :
- عشرة جنيهات فى المنازعات التى تطرح على القضاء المستعجل 0
- خمسة جنيهات فى الدعاوى الجزئية 0
- خمسة عشر جنيها فى الدعاوى الكلية الابتدائية 0
- خمسون جنيها فى دعاوى شهر الإفلاس أو طلب الصلح الواقي من الإفلاس ، ويشمل هذا الرسم الإجراءات القضائية حتى إنهاء التفليسة أو إجراءات الصلح الواقي من الإفلاس ، ولا يدخل ضمن هذه الرسوم مصاريف النشر فى الصحف واللصق عن حكم الإفلاس والإجراءات الأخرى فى التفليسة ، ويكون تقدير الرسم فى الحالتين طبقا للقواعد المبينة فى المادتين 75 ،76 من هذا القانون 0
مادة (3) ( الفقرة الثانية ):
" ويفرض فى الدعاوى المستأنفة مجهولة القيمة رسم ثابت على النحو الآتى :
- عشرة جنيهات على الاستئنافات التى تنظر أمام المحاكم الابتدائية 0
- خمسة عشر جنيها على الاستئنافات التى تنظر أمام المحاكم الابتدائية عن أحكام صادرة من القضاء المستعجل 0
- ثلاثون جنيها على الاستئنافات التى تنظر أمام محاكم الاستئناف العليا 0"
مادة (4) ( الفقرة الأولى ):-
" يفرض رسم ثابت مقداره خمسة وسبعون جنيها على الطعون بالنقض ويفرض رسم ثابت مقداره أربعون جنيها على طلبات وقف تنفيذ الأحكام أمام محكمة النقض 0"
مادة (9) :
" لا تحصل الرسوم النسبية على أكثر من ألف جنية فى الدعاوى التى لا تزيد قيمتها على أربعين ألف جنية 0
ولا تحصل الرسوم النسبية على أكثر من ألفى جنية في الدعاوى التى تزيد قيمتها على مائة ألف جنية ولا تجاوز مليون جنية 0
ولا تحصل الرسوم النسبية على أكثر من عشرة ألاف جنية فى الدعاوى التى تزيد قيمتها على مليون جنية 0
وفى جميع الأحوال ، يسرى الرسم على أساس ما حكم به "0
مادة (30) ( الفقرتان الأولى والثانية ):
" يفرض على الصور التى تطلب من السجلات والشهادات وغيرها رسم مقداره خمسون قرشا عن كل ورقة وبحد أقصى مائة جنية عن الدعوى الواحدة 0
ويفرض على الصور التى تطلب من الأوراق القضائية رسم مقداره خمسة وعشرون قرشا عن كل ورقة فى المحاكم الجزئية ، وخمسة وسبعون قرشا فى المحاكم الابتدائية ، وجنية ونصف فى محاكم الاستئناف ومحكمة النقض "0
مادة (31) :
" يفرض على الكشف من السجلات أو غيرها لاستخراج صورة أو ملخص أو شهادة رسم مقدارة خمسة عشر قرشا عن كل اسم وفى كل سنة وذلك بخلاف رسم الصورة أو الملخص أو الشهادة ويتعدد رسم الكشف بتعدد المطلوب الكشف عنهم ولو كانوا شركاء أو ورثة 0
ورسم الكشف النظرى خمسون قرشا عن كل مادة "
مادة (32):
" يفرض رسم مقداره خمسون قرشا على ترجمة كل ورقة من الأصل المطلوب ترجمته وذلك علاوة على الرسم المقرر فى المادة (30) "0
مادة (34) :
" فيما عدا ما هو منصوص علية فى المادة (51) يفرض رسم مقداره خمسة وعشرون قرشا فى القضايا الجزئية وخمسة وسبعون قرشا فى القضايا الكلية والقضايا الجزئية المستأنفة وجنية ونصف فى القضايا المنظورة أمام محاكم الاستئناف ومحكمة النقض على الأوراق الآتى بيانها :
(أولا) – الأوامر التى تصدر على العرائض سواء قبل الطلب أو رفض 0
(ثانيا)- الأوامر التى تصدر فى طلبات التعجيل سواء قبل الطلب أو رفض "0
مادة (35) ( الفقرة الأولى ): -
" يؤخذ رسم مقداره خمسون قرشا عن كل ورقة من أصل المذكرات التى تقدم بقلم كتاب محكمة النقض "0
مادة (36) :
" يؤخذ رسم مقداره جنية عن كل تأشيرة لإثبات التاريخ كذلك يحصل الرسم على التأشير على أى دفتر من دفاتر التجار ما لم تزد صفحات الدفتر على أربعين فإذا زاد على ذلك كان الرسم ثلاثة جنيهات "0
مادة (38) ( الفقرتان ثانيا وثالثا ):
(ثانيا ) يفرض رسم مقرر مقداره عشرون جنيها على إيداع العلامات والبيانات التجارية والمواصفات الخاصة بالاختراعات وما إليها 0
(ثالثا ) يفرض رسم مقداره جنية على إيداع مفاتيح المنازل والحوانيت وغيرها "0
مادة (42) ( الفقرة الأولى ) :
" فيما عدا الإعلانات التى ترفع بها الدعاوى والتى يقتضيها التنفيذ يفرض على الإعلانات التى تحصل أثناء سير الدعوى بناء على طلب الخصوم أو بسببهم رسم مقداره خمسة وعشرون قرشا على كل ورقة من أصل الإعلان فى القضايا الجزئية وخمسة وسبعون قرشا فى القضايا الكلية سواّء أكانت ابتدائية أم مستأنفة وجنية ونصف فى القضايا المنظورة أمام محاكم الاستئناف أو محكمة النقض "0
مادة (46) مكرراً:
" (أولاّ ) علاوة على رسم التنفيذ المبين فى المواد( 46،45،44،43) يفرض رسم ثابت على الوحة الآتى :
1- جنية على تنفيذ الأحكام وأوامر الأداء الصادرة من المحاكم الجزئية أو إجراءات التنفيذ أمام المحاكم المذكورة 0
2- جنيهان ونصف على تنفيذ الأحكام وأوامر الأداء الصادرة من المحاكم الابتدائية ومحاكم الاستئناف أو إجراءات التنفيذ أمام المحاكم المذكورة وعلى تنفيذ أحكام محكمة النقض .
3- جنيهان ونصف على تنفيذ العقود الرسمية والإشهادات وأحكام المحكمين والأوامر الصادرة من الجهات الإدارية التي يجيز القانون تنفيذ أحكامها 0
وفى حالة إعادة التنفيذ على النوع الواحد المبين بالبند ( أولاّ) من المادة (43) يخفض الرسم الثابت الى الثلث بشرط ألا يقل عن خمسين قرشاّ0
ويعفى من هذا الرسم الأحكام وأوامر الأداء والإشهادات وأحكام المحكمين والأوامر الصادرة من الجهات الإدارية متى كان المبلغ المطلوب التنفيذ من أجلة يقل عن خمسة عشر جنيهاً "0
مادة (54):
" يؤخذ رسم نسبى مقداره خمسون قرشاّ فى الدعاوى والإشهادات التي لا تزيد قيمتها على خمسة جنيهات 0
وفيما عدا ذلك لا يؤخذ رسم نسبى أقل من جنية 0
مادة (55) :
" يعتبر فى تقدير قيمة الدعاوى والإشهادات ما كان من كسور الجنية جنيهاّ 0

مادة (57):
" يفرض رسم مقداره جنية على الأحكام والاشهادات التى يطلب وضع الصيغة التنفيذية عليها من جهة غير التى أصدرتها "0
مادة (60) :
" يحصل رسم مقداره جنيه على التأشيرات الصادرة من قلم كتاب المحكمة المصدق من رئيس المحكمة بإعتماد ختمها المبصوم على الأوراق الرسمية المطلوب استعمالها خارج القطر "
مادة (68) :
" يفرض رسم على الاشهاد رسم مقداره خمسة جنيهات وإذا زاد الاشهاد على ورقة واحدة فرض رسم إضافى مقداره جنية عن كل ورقة من الزيادة "0
مادة (72) (الفقرة الأولى ) :
" يفرض رسم مقداره جنيهان على كل اشهاد بتوكيل أو عزل من الوكالة فإذا زاد الاشهاد على ورقة واحدة فرض رسم إضافى مقداره خمسون قرشاّ على كل ورقة من الزيادة"0
مادة(73) :
" يحصل رسم مقداره جنيه عن التصديق على كل إمضاء أو ختم "0

This is the most amazing place I have ever been during my China Tours (http://www.chinatraveldepot.com/ChinaTours/). Flying into Lhasa by the China Eastern (http://www.chinatraveldepot.com/China-Eastern-Airlines), over the mountains, was breathtaking. As soon as the seatbelt light went off everyone clammored over to take pictures, it was quite a spectacle. There were snow capped mountains as far as the eye could see. We have spent the last few days wandering around the older part of Lhasa, enjoying the beautiful scenery and wonderfully friendly people. There is a monestary at the center of old Lhasa and our China hotel (http://www.chinatraveldepot.com/ChinaHotels)borders the edge of it. We have a great view from the roof of the local people who walk around and around the monestary praying. We toured a monestary one day and the winter palace the next. Both were absolutely beautiful. Today we went out to the childrens home. It was about 20km on the highway and another 20km on a very bumpy dirt road. The scenery on the way was gorgeous. There were not very many children at the home today because most of the go away to school for 2 weeks at a time. They served us the most fantastic meal - all freshly picked vegetables cooked to perfection. We got a little tour of the village and the barley flour mill which is run by the stream. The children here are so adorable. They all have rosey cheeks form the cold. This is just a wonderful place - I have had a great week about my Tibet Travel (http://www.chinatraveldepot.com/Travel-to-Lhasa). I know I said I would get some pictures up but I am finding it difficult. Tomorrow we leave for Kathmandu for a few days and then on the Dhaka to enjoying rest of my China Vacations. The first day we climbed to the top of a 3800m mountain, difficult but pale in comparison to the 6700m mountains encircling us. But nevertheless, I was well convinced that Tibet is one cool place.

Xian in China's Shaanxi Province is famous for its terracotta warriors, but it has many more things to offer as well. Two of Xian's many ancient sites, are the two wild goose pagodas, the Big and Small Wild Goose Pagodas respectively. I got a chance to visit both of them when I travel in China (http://www.chinatraveldepot.com/)last month. Big Wild Goose Pagoda or Giant Wild Goose Pagoda (Chinese pinyin: Dayan Ta), attracts numerous visitors for its fame in the Buddhist religion, its simple but appealing style of construction, and its new square in front of the temple.Among them all, the Big Wild Goose Pagoda is the major point of Xi'an Travel (http://www.chinatraveldepot.com/Travel-to-Xi). There are two well kept Buddhist pagodas from Tang Dynasty, both in Xian and both in the same name. They are therefore called the Big and Small in terms of their size. Between them, the Big one is more famous and attracts more visitors.
The day we went to visit the temple, it was extremeley hot, and sunny, but it did little to distract us from the beauty of the Big Wild Goose Pagoda Temple. It was a really neat place, and fortunantely it had many trees, so there was an abundance of shade. Being one of Xian's hottest sites, the temple was quite crowded, but since it is so large, it is still possible to find little corners without people. The temple complex is set up along an axis, with matching buildings on either side. The buildings were quite beautiful. They were mostly made of grey brick with glazed roofs. The temple houses a number of coffee shops, book stores, and shops, which I wasn't too fond of, but other than that, the temple is wonderful. There is a huge complex for the monks to live in, and the gardens hidden among the temple's many courtyards were very lovely. There are a lot of ancient artifacts hidden throughout the temple. In one area there is a forest of stupas, which are graves for prominent monks. They were very beautiful. Most of them are quite old. We spent a lot of time leisurely strolling, and relaxing in the temple. It was a beautiful spot. The ancient pagoda was stunning. The Small Wild Goose Pagoda is very dainty in its style, but the Big Wild Goose Pagoda is not. It is very solidly built and strong in design. They are two very different pagodas. I sadly did not go inside the Big Wild Goose Pagoda. This is something I will have to remedy next time I go to Xian. I've said it before, and I'll say it again here. There is so much more to Xian than just the terracotta warriors. This ancient city is really amazing and has so much to offer.
