تولى المرأة للقضاء

مازال حق المرأة فى تولى مناصب القضاء لا يعترف به عمليا وقانونيا ولا ينال من هذا الواقع مجرد حالة استثنائية تولت فيها أمرأة واحدة فى مصر منصب القضاء بالمحكمة الدستورية العليا ، حال كون هذه المحكمة لاتحكم فى موضوعات الدعاوى أو تفصل فى خصومة حقيقية بل أن أختصاص هذه المحكمة الدستورية قاصر على فحص نصوص القوانين ومدى مطابقتها للدستور من عدمه ، وهو ما يحق معه القول بأن حتى هذه المرأة الوحيدة لم يسمح لها أن تتولى منصبا قضائيا عمليا أو فعليا فى مصر ، ونحمد الله أن قاون التحكيم قد سمح بذلك وأعطى المرأة حق أختيارها كمحكم ولم يفرق فى ذلك بين الرجاء والنساء أو بين الوطنى والأجنبى فى صلاحيةتهم للتحكيم وفقا للقاون المصرى ، وهو سلوك محمود يثنى عليه من المشرع ، لكن هل الواقع العملى المتمثل فى حق الخصوم فى أختيار محكمهم بأرادتهم الحرة الطليقة ، يمكن أن يسمح للنساء بالمشاركة فى القضايا التحكيمية عمليا أم لا ؟؟؟؟
