للأسف قانون التحكيم لا يدرس فى كل كليات الحقوق بالجامعات المختلفة بجمهورية مصر العربية بل تتم دراسته فى بعض الجامعات دون غيرها ، بل وتتم دراسته كجزء صغير تابع لمادة ( المرافعات ) ، ولذلك فأن الكثير من المحامين لا يعرفون كثيرا عن قانون التحكيم - ولا أبالغ أن قلت لا يعرفون شيئا عن التحكيم وأحكامه ونظامه - فما بال باقى الناس العادية الغير مشتغلين بالقانون ، فكيف سيكون تصورهم وعلمهم بالتحكيم ، والحقيقة أنه لا بد من ثورة لثقافة التحكيم فى مصر فهى تكاد البلد المتأخر كثيرا فى هذا المجال الحيوى والهام والذى يخفف عن كاهل القضاء الرسمى من خلال التقليل من عدد القضايا المنظورة أمامه برغبة الأطراف والخصوم ، وهو نظام عتيق وأساسى لدى القوانين الأوربية والأنجلوسكونية ، ويعد قضاء التحكيم أهم شروط المستثمرين الأجانب فى أى دولة نامية أو غيرها ، ولقد سبقتنا حتى الدول العربية الصديقة والمجاورة فى أنتشار هذا النوع من القضاء الخاص الذى يشارك القضاء الرسمى مسئوليته فى حسم النزاعات بين الهيئات الحكومية والأفراد والشركات وغيرها ، ومازلنا نحن المصريين فى آخر الركب ونمضى فيه ببطىء شديد ، وليس أدل على ذلك أكثر من أن المواقع العلمية والمواقع المتخصصة على الأنترنت تعانى من ندرة شديدة نسبيا من الزوار لها بالمقارنة بالمواقع الترفيهية أو الدعائية أو اللاأخلاقية ، وكأننا حريصون دائما على صفر المونديال فى كل المجالات

يمكن ترتيب دورات في التحكيم بين كافة التخصصات وعلى رأسها المحامين والمهندسين لنشر هذا الأمر وأتوقع أنه في خلال العامين القادمين سوف يأخذ مكانته في مصر بالقدر الذي يتناسب معه

طالعتنا الصحف القومية والمعارضة بطعن مستشارى مجلس الدولة فى القانون الجديد المزمع أصداره والمسمى بقانون المحاكم الأقتصادية الجديد ، وتم سياق مبررات عدم دستورية هذا القانون قبل صدوره لتعارضه مع اختصاصات قضاء مجلس الدولة الواردة بالدستور المصرى ، فهل هذه البادرة لهذا القانون قبل صدوره من شأنها تدعيم الأقتصاد المصرى أو تشجيع الأستثمار فى مصر ونحن نرى هذا النزاع الدائر على صفحات الصحف والمجلات بخصوص هذا القانون ، ولماذا لا يقوم مجلس الشعب أو الشورى بعرض مشروعات القوانين الجديدة بالصحف وطرحها للمناقشة وابداء الرأى فيها قبل صدورها للأستفادة بجميع الآراء المتنوعة والمتباينة بين المتخصصين فى القانون واساتذة الجامعات ولا يكون الأمر قاصرا على أعضاء مجلسى الشعب والشورى ولا سيما أن نصف عددهم عمال وفلاحين وليس جميع الفئات قانونيين !!!!!!!
