الثقة الغائبة عن قضاء التحكيم
مشكلة المواطن المصرى أنه فى ظل الفساد الذى استشرى بين كافة الجهات والمؤسسات بصورة رهيبة قد اضحى فاقدا الثقة فى كل شىء حوله لدرجة تقاربت من الشك فى احكام القضاء الرسمى
وأن هذه الثقة مفقودة حتى فى القضاء المصرى الرسمى ، إذ يتلاحظ كثرة القضايا وتكدسها نتيجة الطعون المتكررة فى الأحكام ، فيستوى فى ذلك من صدر الحكم ضده ومن صدر الحكم لصالحه فى الطعن بالمعارضة والاستئناف
فما بال ثقة المواطن المصرى فى القضاء التحكيمى الذى يباشره أشخاص عاديين وليسوا قضاة أو أصحاب سلطة وفى أمور مالية وقد تكون قيمتها كبيرة جدا وهو ما يثير أحتمال الرشوة أو الميل المادى لصالح أحد الخصوم ، وأن اعتبار حكم التحكيم حكم نهائى بات يزيد من هذه المخاوف والشكوك ويحجب الكثيرون عنه خوفا من ضياع حقوقهم
أن الثقة فى قضاء التحكيم تحتاج مزيدا من الوقت وتتطلب كثيرا من الجهد والأنتشار الأعلامى القوى لتأكيد هذه الثقة لدى المواطن والتاجر فى قضاء التحكيم ليحقق الهدف منه ، ورغم كونى لا أعتقد أن يلاقى ذلك قبولا لدى جهات الأعلام الرسمية باعتبار أن تشجيع نظلم التحكيم سيقلل من شأن قضاء الدولة الرسمى ، ولكنى أذكر غذا كان ألأمر كذلك فلماذا صدر مثل هذا القانون الخاص بالتحكيم
وكيف سنواجه العالم الخارجى وقد أتجه بالفعل إلى هذا القضاء الناجز الذى يحقق غاية المستثمر فى أنهاء نزاعاته بسرعة ويسر فضلا عن حجية حكم التحكيم أمام كافة الدول الأخرى وخاصة فى ظل توافر مزية لاتوجد فى أى قضاء وطنى رسمى وهى أختيار القانون الذى سيطبق على النزاع بمعرفة أطراف التحكيم دون التزام بالقضاء الوطنى أو القانون الداخلى للدولة التىيتم الاستثمار على أرضها
كما أن الخبرة والممارسة الفعلية والعملية لقضاء التحكيم من قبل المحامين والمحكمين المصريين - من شأنها على أقل تقدير - أن توفر لنا عدد من المحكمين المصريين ذوى الكفاءة لتمثيل المصالح الوطنية الرسمية والخاصة على حد سواء امام قضاء التحكيم الدولى ولا نضطر للأستعانة إلى محكمين أجانب كما يحدث الآن بالفعل فى التحكيمات الدولية التى تكون جمهورية مصر العربية طرفا فيها ولا يمثلها محكمين مصريين الجنسية
