قانون التحكيم بين الواقع والمسستقبل - موضوع للمناقشة

ِِِِقانون التحكيم بين الواقع والمستقبل
مما لاشك فيه أن أختلاف الآراء رحمة وضياء ، وأن كل الأمور الواقعية والفكرية تحتمل الجدل وتقبل المناقشة والحوار وصولا لوجه الحق فيها ، وأن الأجماع التام على شىء ما 00 بات ضربا من ضروب المستحيل
ومن هذا المنطلق وسياقا مع هذا المفهوم العام للنقد والمناقشة والتحليل ، نجد أن المقارنة بين نظام القضاء التحكيمى الأختيارى الذى أوردته أغلب المجموعة الدولية ضمن تشريعاتها الداخلية وبالتناسق والتناغم مع نموذج القانون الدولى للتحكيم ( اليونستيرال ) قد بات بين كفتى الميزان مع النظام القضائى الرسمى لتلك الدول ، وفى مجال الترجيح بين النظامين نجد الأنشقاق ما بين مؤيد ومعارض لترجيح أحد النظامين على الآخر ولكل منهما رأيه وأسانيده المقبولة 0ولعلنى أرى شخصيا 000 انه لم يعد التحكيم طرفا حضاريا لنخبة ما وأنما هو أداة للتغيير وحتمية للأفضل دونما تفريط فى قضاءنا الوطنى العادل
فهل يشاطرنى السادة رواد المنتدى فى ذاك الرأى 0000 وهل من أضافة فى الآراء والرؤى الخاصة بكل منهم 000 أرجو المشاطرة وتبادل الآراء فى هذا الخصوص

]الشرط والمشارطة كصور لأتفاق التحكيم[/CENTER]
أولا / شرط التحكيم : هو بند من بنود عقد من العقود المدنية أو التجارية أو الأدارية يتضمن الأتفاق يتفق فيه الأطراف على أن يتم الفصل فى أى نزاع قد يحدث مستقبلا حول تفسير هذا العقد أو تنفيذه ، يتم الفصل فيه بطريق التحكيم ومن ثم فإن هذا البند الذى يورد شرط التحكيم ينصب على نزاعات مستقبلية محتملة الحدوث ولم تحدث بعد وهذا النزاع غير محدد تفصيلا وقت أبرامه 0
وفى هذه الحالة التى يرد فيها هذا الشرط الأتفاقى فى العقد الأصلى مصدر الرابطة القانونية ، فأنه يستقل هذا البند المتضمن شرط التحكيم عن كافة بنود العقد الأخرى الواردة به ، فلا يبطل هذا الشرط ببطلان ذاك العقد أو العكس ، بل يكفى أن يكون هذا الشرط صحيحا فى حد ذاته وقد صدر عن أرادة حرة واعية خالية من العيوب والشوائب ، ومن ثم تختص هيئة التحكيم حينئذ بالفصل فى مدى صحة أو بطلان العقد الأصلى كما لو تم ابرام العقد بواسطة شخص ناقص الأهلية مثلا 0
وقد يرد هذا البند فى اتفاق ملحق لهذا العقد الأصلى ( اتفاق مستقل ) يحرر فى ذات توقيت تحرير العقد الأصلى قبل حدوث أى نزاع ، فلا يخرج عن كونه شرط تحكيم أيضا ، ولا يعتبر مشارطة تحكيم ، لكون النزاع غير محدد ولم يحدث بعد

وشرط التحكيم يتسع ليشمل كافة المنازعات التى تنشأ بين أطراف العلاقة التعاقدية – مالم يتفق الأطراف على خلاف ذلك - وسواء تعلقت هذه المنازعات بصحة العقد أو تنفيذه أو تفسيره أو المسئولية عن عدم التنفيذ أو المسئولية عن التأخير أو التنفيذ المعيب أو سوء النية فى التنفيذ 0
ويلاحظ انه يجب أن يتضمن شرط التحكيم – أن لم يسند إلى مركز معين – طريقة تعيين المحكمين ولا يشترط تسميتهم فأن لم يتضمن ذلك لم يكن الشرط باطلا ولكنه يصبح غير قابلا للتنفيذ العملى إلا بمقتضى أتفاق لاحق بين الأطراف ذاتهم لأستكمال هذا النقص ، أو باللجوء إلى القضاء وفقا لقانون التحكيم المصرى لتعيين المحكمين فى النزاع الذى نشب بينهما 0
وقد يسند شرط التحكيم إلى أحد مراكز التحكيم المؤسسية التى تملك جهازا يختص باختيار المحكمين كلما دعت الضرورة لذلك ، وبيستمد المركز سلطته فى تعيين المحكمين وتسميتهم من أتفاق الأطراف على أختيار هذا المركز أو المؤسسة – كسلطة تعيين وتنظيم العملية التحكيمية - وتتفاوت أهمية هذه المراكز من حيث الثقة والخبرة والسمعة و القدم والنشاط والشهرة التى تتمتع بها وعدد القضايا التحكيمية التى تعرض عليها

وشرط التحكيم على هذا النحو سالف الذكر لايعد من قبيل الدعاوى أو التصرفات الواجب شهرها ، وأنما هو مجرد أتفاق على عرض النزاع على المحكمين والنزول على حكمهم
ويتعين فى حالة تنفيذ هذا الشرط باللجوء للتحكيم ان يتم تحديد موضوع النزاع فى بيان الدعوى المشار إليه فى الفقرة الأولى من المادة ( 30 تحكيم ) على خلاف الحال فى مشارطة التحكيم والتى يجب أن تتضمن تحديد موضوع النزاع الذى حدث بالفعل والمبرر لأبرام هذه المشارطة ، إذ عدم التحديد هنا من شأنه ( أبطال ) هذه المشارطة
